1.1. This policy statement applies to personal information submitted to Xylonor 202 CC t/a FAMPAK Packaging Distribution (registration number [2011/012206/23]), its agents, holding companies, affiliates and any entities managed by Xylonor 202 CC t/a FAMPAK Packaging Distribution (collectively and individually, referred to as “FAMPAK Packaging Distribution”, “we” ,“our” and “us”).

1.2. In terms of the Protection of Personal Information Act 4 of 2013 (“the Act”) we are required to provide you with this notification.

1.3. This privacy statement outlines the types of personal information we collect, whether directly from you or from third parties on your behalf, and explains how we use, process and share this information within FAMPAK Packaging Distribution and with our authorised service providers.

1.4. For the purposes of this privacy statement, the term “personal information” shall have the same meaning as is ascribed to it in section 1 of the Act.

2.1. By accessing our website, communicating electronically with us and engaging our services,

you consent to –

2.1.1. the collection, processing and transfer of your personal information as set out in this privacy statement;

2.1.2. our accessing and using such personal information, furnishing the operators therewith for the operator’s use, in order for us to render our services.

2.2. FAMPAK Packaging Distribution undertakes to implement all reasonable measures in accordance with this statement to safeguard your personal information and to maintain its confidentiality.

2.3. You have the right to opt out of receiving marketing or other communication from us at any time and you may withdraw your consent to our communications whenever you choose.

2.4. We undertake not to send unsolicited marketing emails or communications, nor shall we share or sell your personal information to any third parties.

3.1. We collect personal information related to your business, associated individuals, and any references provided by you.

3.2. This information includes, but is not limited to, information in respect of –

3.2.1. an individual, such individual’s names, age, email addresses, telephone/mobile numbers, identity documents, physical addresses and credit or debit card details;

and

3.2.2. an entity, such entity’s name, registration number, VAT numbers, email addresses, telephone/mobile numbers, physical addresses and credit or debit card details. If necessary, such information shall include details of the directors and/or employees of such entity, the banking details thereof, information pertaining to such entity’s shareholders and sureties as well as all forms and documents signed by you in relation to the sale of goods, payment history and any other information pertaining to your business which has been furnished by you to us and provided to us on a voluntary basis.

4.1. FAMPAK Packaging Distribution will only process personal information that is necessary for the purposes for which it is collected.

4.2. Such purposes may include, but shall not be limited to –

4.2.1. assessing the financial stability of your business;

4.2.2. monitoring your payment history with us; and

4.2.3. performing credit checks on you, your business and any associated sureties.

FAMPAK Packaging Distribution may disclose your personal information to third parties in the following circumstances, which shall include but not be limited to –

5.1.1. where your explicit consent has been provided to us by you;

5.1.2. where required or compelled to do so by law;

5.1.3. to our service providers involved and engaged in delivering our services; and

5.1.4. for the purpose of conducting credit checks on you, your business and your associated sureties.

6.1. FAMPAK Packaging Distribution undertakes to –

6.1.1. implement appropriate technical and organisational measures to prevent the unauthorised and unlawful access, disclosure, or misuse of your personal information and in doing so, shall safeguard and protect your personal information in its possession and/or under its control;

6.1.2. verify the security of your personal information in our possession and/or under our control on a regular basis and shall update security and safeguarding measures and policies regularly to ensure the ongoing protection of your personal information;

6.1.3. update your personal information as and when required by you, in writing. For the purposes of clarity, it is recorded that we shall not update and/or verify your personal information without having acquired your prior written instructions and we shall not, save for gross negligence on our part, be liable for, inter alia, any errors, omissions and/or unauthorised access to your personal information; and

6.1.4. allow you access to your personal information as and when required by you.

6.2. Notwithstanding all of the above, FAMPAK Packaging Distribution cannot guarantee the absolute security of any information which you exchange with it and to the extent permitted by law, we shall not be held liable for any losses, claims or damages which may arise from any unauthorised access, disclosure or misuse of your personal information.

7.1. Personal data and information shall not be retained for longer periods than is necessary to fulfil the purpose for which it was collected and processed, unless otherwise required by law.

. Pursuant to the provisions of the Act, you have the right to, inter alia –

8.1.1. request access to your personal information in our possession and/or under our control;

8.1.2. require that corrections and/or amendments be made to your personal information where necessary and from time to time;

8.1.3. object to the processing of your personal information; and

8.1.4. withdraw any consent which you may have previously provided to us and to require that we delete, destroy, erase and/or return any such personal information held by us on your behalf.

9.1. Our appointed information officer is Vincent Van Den Berg who is responsible for overseeing compliance with this privacy statement and who is available to discuss any information you may require regarding your personal information.
